As part of the program for developing the research skills of postgraduate students, the College of Law at the University of Al-Qadisiyah organized a specialized scientific workshop entitled: “An Introduction to Legal Research Methodologies: Their Nature and Characteristics.” The lecture was delivered by the Dean of the College, Professor Dr. Nidham Gabbar Talib, and the session was moderated by Assistant Professor Dr. Ali Hamza Jabr, the Postgraduate Studies Coordinator.
Objectives of the Workshop :
The workshop aimed to deepen the understanding of master’s and doctoral students regarding the methodologies of scientific research in the legal field by clarifying their nature, characteristics, and areas of application in academic studies. It also focused on explaining the methodological foundations that researchers must adhere to when selecting any research method, as well as the rules governing their use. Moreover, the workshop highlighted the importance of recognizing the particularities of each legal system—whether rooted in the Latin or Anglo-Saxon tradition—and their impact on shaping the adopted research methodology.
Key Findings
The workshop concluded that legal research methodologies are not merely descriptive tools but rather analytical and critical mechanisms designed to enhance the quality of national legal norms. This is achieved through the incorporation of comparative legislative experiences and by identifying and addressing gaps or shortcomings in national legislation. Such an approach ensures the continuous development of the Iraqi legal system on sound scholarly bases. Additionally, it was emphasized that the nature of a country’s legal system—Latin or Anglo-Saxon—constitutes a decisive factor in determining the most appropriate methodology for legal research, thereby requiring researchers to remain aware of the essential differences between these systems.
Recommendations
The workshop recommended that researchers exert conscious scholarly effort in selecting the methodology most suitable to the nature and objectives of their studies. It further stressed the importance of supporting legal research with doctrinal, judicial, and empirical evidence that strengthens its argumentative power. This would allow for the effective testing of proposed recommendations should they be presented to the Iraqi legislator.
